18 U.S.C. § 2257 — Record-Keeping Compliance Statement

In compliance with the Child Protection and Obscenity Enforcement Act of 1988 (18 U.S.C. § 2257) and its implementing regulations (28 C.F.R. § 75), all visual depictions of actual sexually explicit conduct hosted on www.4fanly.com are exempt or, where applicable, subject to the record-keeping requirements set forth below.

1. Nature of 4fanly

4fanly is a creator-driven platform where independent content creators upload their own original material. Pursuant to 28 C.F.R. § 75.7(a), 4fanly is the secondary producer of any visual depictions appearing on the website only insofar as it hosts and transmits material produced by third-party creators.

2. Primary producers

Each individual creator is the primary producer of the visual depictions they upload. Pursuant to 28 C.F.R. § 75.6, each creator is required to maintain age-verification records and identification documents for each performer appearing in their content.

3. Age verification

All creators and performers on 4fanly are required to be at least 18 years of age at the time of content creation. Age verification is performed via government-issued identification and biometric selfie matching through the certified KYC provider Persona Identities, Inc. before any age-restricted content can be uploaded or accessed.

4. Records custodian

For content where 4fanly is the secondary producer, the records required under § 2257 are maintained by the original (primary) producer. For administrative inquiries directed to 4fanly, the designated custodian of records is:

5. Exempt content

Material that does not contain actual sexually explicit conduct as defined in 18 U.S.C. § 2256(2)(A) is exempt from § 2257 record-keeping. This includes simulated or non-explicit content.

6. Reporting and removal

Any party who believes that age-verification records are insufficient or that underage content is present on the platform must immediately notify abuse@4fanly.com. We treat such reports with the highest priority and cooperate fully with the National Center for Missing & Exploited Children (NCMEC) and law enforcement.

7. Italian-law notice
